CONDITIONS OF ACCESS AND USE OF THE FSD WEBSITE

Welcome to the website of the Djibouti Sovereign Fund (“FSD”).  

The use of this is subject to the conditions of access and use releases outlined below (the “CAU”).

Object

The purpose of these CAU is to define how the FSD Site (the “Site” is used).

Any access and/or use of the Site in any way implies unconditional acceptance and respect for all the terms of these CAU. They are therefore a commitment of the User.

In the event that the User does not wish to accept all or part of these CAU, he is asked to forego all use of the Site.

Definitions:

  • Site: The FSD website
  • User: The User is anyone who uses the Site or any of the services or information offered on the Site.

Conditions of access to the Site

The Site is accessible free of charge to any User with internet access. The User is solely responsible for the proper operation of his computer equipment as well as his access to the internet.

The FSD reserves the right to refuse access, unilaterally and without prior notification, to any User who does not comply with these CAU.

The Site uses all reasonable means at its disposal to ensure quality access to the Site, but is under no obligation to do so. In addition, the
FSD cannot be held responsible for any network or server malfunctions or other events beyond reasonable control that would prevent or degrade access to the Site.

The FSD reserves the option of interrupting, temporarily suspending or modifying access to all or part of the Site without notice, in order to maintain it, or for any other reason, without the interruption being entitled to any obligation or compensation.

Information contained on the Site

The information provided on the Site is there as an indication.

The FSD cannot guarantee the accuracy, completeness and news of the information disseminated on the Site.

The FSD makes every effort to provide users with information and/or tools available and verified, but cannot be held responsible for errors or omissions, lack of availability of information and services. Despite all the care taken to build and update this site, errors, inaccuracies or omissions may remain, as well as problems with connection to the Site or interruption of connection.

As a result, the User acknowledges that he will be using this information under his sole responsibility and refrains from any claim or action on this basis.

Intellectual property and neighbouring rights

The Site and all the elements that constitute it (including drawings, models, photos, illustrations, images, soundtracks, graphic charters, texts, logos, brands…) are the exclusive property of the FSD.

As a result, you are prohibited from using, representing or partially reproducing, by any process, distributing, publishing, transmitting, modifying or selling all or part of the content of the FSD site, or creating works derived from it.

The FSD related logos displayed on the Site, as well as the domain name “https://www.fsd.dj” are and will remain the exclusive property of the FSD.

Any reproduction, distribution, transmission, modification or use of these elements without express and prior agreement of the FSD, for any reason, is prohibited and exposes the perpetrator to the FSD’s action for damages without prejudice to criminal proceedings.

You can make a copy of the web pages published on the Site for your private, personal and non-commercial use, provided that any copy of these web pages retains all mentions of copyright and exclusive rights contained in them.

The FSD disclaims any responsibility for the illegal use or exploitation of the items (including drawings, photos, models, illustrations, images, soundtracks, graphic charts, texts, logos, marks and other distinctive signs) contained on the Site.

Personal data protection

The FSD is committed to taking the necessary measures to ensure that personal data, possibly disclosed by the User, is treated in accordance with the legal provisions in this area, including the provisions of the General Data Protection Regulation (GDPR) – EU 2016/679.

The Site can offer you links to other sites operated by parties other than the FSD. The FSD cannot be held responsible for the content of the sites to which it is referred and over which it has no control.

The FSD will not assume the direct or indirect damage resulting from this content. All links to other sites are provided as a simple convenience to the Users of this website.

Limitation of liability

The FSD cannot, under any circumstances, be held liable for losses resulting from or relating to access to the Site or the use of the information or software available on  the Site, either directly or indirectly, including, without limitation, liability relating to any deprivation of enjoyment, loss of exploitation, loss of profits or loss of data, or incidental damage, special or consecutive of any kind, regardless of the form of action, whether under contract law, civil liability (including quasi-tortious misconduct) or otherwise, even if the FSD has been warned of the possibility of such damage.

Furthermore, the FSD cannot be held responsible for any direct or indirect damage that could result from access or use of the Site, including inaccessibility, data loss, damage, destruction or viruses that could affect the User’s computer equipment, and/or the presence of viruses on the Site. 

Changing the Conditions of Access and Use

The FSD reserves the right to enrich, modify and periodically correct the CAU. Once amended, the CAU will take effect on the date of their posting on the Site. As a result, users should regularly consult these CAU.

Applicable law and jurisdiction for dispute resolution

These CAUs will be governed by and interpreted in accordance with Djiboutian law.

Any dispute arising from or in connection with CAU, shall be submitted to the competent courts of the Republic of Djibouti.

The FSD’s waiver to assert a violation of one of the stipulations of the CAUs will not be construed as a permanent waiver or a waiver to assert a violation of another stipulation.
